General Terms and Conditions
These General Terms and Conditions ("guideit SAL"), along with our Privacy Policy (https://www.guideit.info/privacy_policy), govern your use of the guideit online platform ("guideit app"). This platform can be accessed via (i) http://www.guideit.info and (ii) certain mobile applications provided by guideit. The guideit Platform is available to users globally. Specific sections of these General Terms and Conditions may apply to you based on your location or region.
1. About Us
We, guideit SAL, with a registered address at Mount Lebanon, Gardenia Street, section5, Plot n 1610/Baabda, Lebanon, ("guideit," "we," or "us"), operate the guideit app and are responsible for its management. Our platform is accessible worldwide in multiple languages, offering a seamless and user-friendly experience.
guideit serves as an intermediary platform where various tours and activities ("Activities") are offered online by local activity providers, including amusement parks, museums, tour guides, boat tour operators, and other service providers worldwide ("Suppliers"). These Activities may include guided tours, cooking classes, sightseeing bus tours, boat trips, attraction tickets, adventure experiences, diving excursions, and other related services.
As a commercial agent for Suppliers, we facilitate bookings but do not create or control the content related to these Activities, including descriptions, photographs, or other materials, which are provided directly by the respective Suppliers. As such, we do not have direct influence over this content.
2. Scope
2.1 Applicability
These guideit General Terms and Conditions apply to all visitors and users of the guideit app and website, including all content offered through supported operating systems (currently iOS and Android) ("Users"). By using the guideit app, you agree to comply with these guideit terms and conditions. We encourage you to read them carefully upon first use.
2.2 Coverage of Terms
These terms are accessible online and govern all of our services unless specific terms and conditions apply to a particular service. If any service is subject to more specific terms, we will clearly indicate this at the appropriate time. Any user-provided terms and conditions that conflict with or deviate from the guideit T.C will not be applicable unless expressly agreed to by us in writing.
2.3 Personal Use Only
The guideit Platform is intended for personal use only. Under no circumstances may it be used for business purposes. Reselling tickets is strictly prohibited! Any use beyond personal, non-commercial purposes—such as reselling tickets for profit, using the platform for business activities, or making purchases on behalf of third parties for commercial gain—is expressly forbidden.
3. Our Role
3.1 Intermediary Platform
The guideit app allows you to browse and book various Activities. However, the contract for the actual provision of an Activity is formed exclusively between you and the Supplier/Guide ("Service Agreement"). When you purchase an Activity through the guideit app, you are not purchasing from us, but directly from the Supplier. guideit acts solely as a commercial agent for Suppliers.
We are commissioned and authorized by Suppliers to facilitate transactions between Users (yourself) and Suppliers, process bookings on their behalf, and collect payments from Users.
While we mainly act as an intermediary, there may be occasions when guideit SAL itself offers and operates certain Activities. In such cases, we will clearly indicate that guideit is the direct provider of the Activity.
Unless explicitly stated otherwise, guideit does not act as an organizer, landlord, reseller, or other contractual party in relation to your Service Agreement. Our primary role is to facilitate agreements between Users and Suppliers, for which we receive a commission from the Supplier.
3.2 Customer Support and Communication
To ensure a smooth and efficient experience, you can direct any questions or concerns about your booking to guideit's customer support team. You'll find various contact options—such as forms and support details—on our Contact Us page, as well as via our customer service hotline.
As commercial agents, we assist Suppliers by handling communication and support requests on their behalf. Our goal is to respond within 24 hours, and typically no later than 48 hours. You may also choose to communicate directly with the Supplier. In urgent situations, the Supplier's contact information can be found on your voucher or ticket.
3.3 Usage Restrictions and Booking Conditions
We reserve the right to make access to the guideit app & Website — or specific features within them—subject to certain conditions. These may include factors such as your previous payment behavior (e.g. history of past bookings) or the submission of specific documentation (such as proof of identity, purchase, payment, or ownership).
Additionally, we may restrict your ability to book Activities or cancel existing bookings if we have reason to suspect fraud, a breach of guideit T&C, or a violation of any obligations arising under a Service Agreement that has come to our attention.
3.4 Platform Availability and Service Continuity
guideit reserve the right to suspend or discontinue any part of our services at any time, and users do not have a guaranteed right to continued access.
However, if you have already entered into a Service Agreement with a Supplier, the provisions outlined in Section 15 will apply to that agreement and remain unaffected.
4. Registration and guideit Account
4.1 Optional Registration with Additional Features
You can access most parts of the guideit Platform without registering. However, to unlock all features—such as saving experiences to your Wish List—you'll need to create an account.
4.2 Creating a guideit Account
To set up your guideit account, you'll need to complete the registration form by providing your full legal name and a valid email address. You may choose to create a password or, where available, register using a passwordless login via a secure email verification link.
It is your responsibility to keep your account credentials confidential and prevent unauthorized access by third parties. Once you click the "Confirm email" button, you'll receive a welcome email from guideit confirming that your account has been successfully created.
4.3 Account Limitations and Ownership
Each individual is allowed to create only one guideit account as a User and one account as a Guide each with a different username and email. Please note that guide accounts are subject to verification by the guideit team within 48 hours of creation.
Creating a guide account does not automatically grant permission to publish content or offer services on the guideit app or website. All guide accounts must first meet guideit's eligibility criteria and receive approval.
All accounts are strictly non-transferable, you may not assign, share, or transfer your account to any other person.
5. guideit Apps
5.1 License to Use the guideit Apps
Subject to the terms of this Agreement, we grant you a limited, non-exclusive, revocable, non-transferable, and non-sublicensable license to download, install, and use the guideit mobile apps on your personal device. This license is strictly provided under the following conditions:
- a. Your use of the guideit app must be for personal, non-commercial purposes only.
- b. You must comply with all usage restrictions outlined in these Terms.
You are not permitted to copy, distribute, lease, lend, modify, adapt, sublicense, or create derivative works from the guideit apps. If you sell or transfer your mobile device to another person, you are required to remove the guideit app before doing so.
You may not reverse-engineer, decompile, disassemble, or attempt to extract the source code of the app or any of its components, unless explicitly allowed by applicable law.
All rights not specifically granted to you remain the property of guideit and its licensors.
5.2 App Updates
From time to time, "guideit" may, at its sole discretion, release updates to the guideit app. These updates may include upgrades, performance improvements, bug fixes, patches, new features, or other enhancements (collectively referred to as "Updates"). Some Updates may also remove or alter existing features and functionalities.
You acknowledge that guideit is not obliged to provide any specific Updates or to maintain any particular features or functions over time.
Depending on your device settings and internet connection:
- a. Updates may be automatically downloaded and installed on your mobile device, or
- b. You may receive a notification prompting you to download and install available Updates.
You agree to promptly install all Updates, understanding that parts of the guideit app may not function correctly if you choose not to install them.
All Updates are considered part of the guideit app and are subject to the terms and conditions outlined in these guideit T&C.
5.3 Data Collection Through App Usage
By downloading, installing, or using the guideit app, you acknowledge that guideit may employ automated tools—such as cookies, SDKs, and web beacons—to collect information about your mobile device and how you interact with the app.
You may also be asked to provide certain personal information as a prerequisite for accessing the app or specific features and functionalities.
All data collected through or in connection with the guideit app is handled in accordance with our Privacy Policy. You retain control over certain types of data processing and can opt out by declining consent when prompted by the app.
6. Formation of the User Agreement with guideit
6.1 Purpose of the Agreement
By entering into a User Agreement with guideit, you gain access to use the guideit app and website free of charge. This agreement governs your use of the platform and its services.
6.2 Purpose of the Agreement
Your contractual relationship with guideit begins the moment you access or use the guideit Platform, including by installing the guideit app. You may request to deactivate, terminate, or delete your guideit account at any time by reaching out to our customer support team via phone or through the "Delete Account" option available on our Contact Us page.
6.3 Termination by guideit
guideit may, at its discretion, terminate your User Agreement, account, or platform access with one week's notice. However, termination will only take effect once any active Service Agreements have either been completed or canceled. This does not affect our right to terminate immediately if there is a valid reason to do so.
6.4 Gift Cards
guideit offers Gift Cards that can be used exclusively for purchases made through the guideit Platform. Unless otherwise stated by applicable law, these Gift Cards are valid until the end of the third calendar year following the year of purchase. After this period, the Gift Card will expire automatically.
Gift Cards cannot be exchanged for cash, except where this is legally required. If we detect or suspect any fraudulent activity, misuse, or unlawful behavior related to the purchase or use of a Gift Card, we reserve the right to suspend or close the associated user accounts and may require an alternative payment method.

7. Customer Service & Best Price Guarantee
7.1 Reaching Customer Support
You can contact our customer support team anytime through our Contact Us page. We're available via phone, live chat, or email to assist you.
7.2 Best Price Guarantee
If you find the same Activity
(i) on the same date and in the same city,
(ii) with identical services,
(iii) for the same number of people, and
(iv) offered by the same Supplier
at a lower price elsewhere online, and you can provide proof, guideit will refund you the difference between the price you paid and the lower price you found. Please note that prices offered through trust or loyalty programs are not eligible for this best price guarantee.
7.3 How to Claim
To request a price match, you'll need to provide us with a link or screenshot of the competing offer. Once we verify that the lower-priced Activity meets all the necessary criteria, we'll issue a refund for the difference—either as a monetary payment or a voucher.
7.4 Special Offers & Promotions
All limited-time deals and discount campaigns on the guideit platform will be clearly marked as special offers.
8. Payments on guideit
8.1 Pricing and Payment Conditions
The price shown on the guideit Platform for an Activity (referred to as the "Journey Price") is the standard rate offered. The amount you are required to pay (the "Booking Price") will reflect the Journey Price minus any valid discounts applied at the time of booking.
Unless stated otherwise, the Booking Price must be paid in full at the time of booking.
8.2 "Reserve Now, Pay Later" Option
For certain Activities, you may have the option to select the "Reserve now, pay later" feature. To use this option, you must provide a valid credit card that remains active through the date of the booked Activity. As part of the booking process, we will perform a 0 EUR authorization to verify the card's validity.
The Booking Price will be charged 72 hours before the scheduled start of the Activity. If the payment attempt is unsuccessful, you'll have 47 hours to complete the payment manually. Failure to make the payment within this timeframe will result in the automatic cancellation of your reservation.
8.3 Payment Collection on Behalf of Suppliers
guideit is the sole party authorized to collect payments for Activities booked through the guideit Platform. All payments are received by guideit in its role as a commercial agent acting on behalf of the Supplier.
Once your payment is successfully made to guideit, your financial obligation to the Supplier is considered fully settled.
If the Activity's price is listed in a foreign currency, guideit may process the payment in your local currency and convert it at the applicable exchange rate at the time of booking. For currencies that are highly volatile, we may apply a reasonable currency conversion fee.
8.4 Refund Requests Outside the Cancellation Policy
As the commercial agent of the Supplier, guideit is your point of contact for matters related to the Service Agreement and associated payments. If you wish to request a refund outside of the standard cancellation policy, you may reach out to us directly.
We will forward your request to the relevant Supplier, who will independently determine whether to approve the refund. If the Supplier agrees to issue a refund, guideit will process the refund on their behalf.
8.5 Payment Information and Authorization
You are required to provide accurate and up-to-date payment information when booking an Activity. If any of your payment details change, you must update them immediately.
The accepted payment methods for each Activity will be shown to you during the checkout process. The terms and conditions of the respective payment service provider will apply, and additional fees may be charged by your payment provider.
By submitting your payment information, you confirm that you are authorized to use the selected payment method or have been granted the right to do so.
8.6 Payment Authorization and Credit Check
By authorizing a payment, you give your consent for your payment details to be used by guideit to collect payment on behalf of the Supplier.
We reserve the right to make access to the payment function—or to specific payment methods offered on the guideit Platform—subject to a creditworthiness check. This is to ensure secure and reliable transactions for all parties involved.
9. Changes and Cancellations
9.1 Cancellation Terms
You may cancel a Service Agreement solely in accordance with guideit's cancellation policy. The full cancellation terms are available on the guideit website and app, under Profile Legal.
Additional Notes for Travelers
Important Refund Policy
- Canceled by the Guide? → If the guide cancels unexpectedly, you will receive a full refund automatically.
- Canceling More Than 48 Hours in Advance? → You're eligible for a full refund if you cancel more than 48 hours before the journey.
- Canceling Within 48 Hours? → Unfortunately, cancellations made less than 48 hours before the trip are non-refundable.
- Minimum Participants Not Met? → If the required number of participants is not reached 24 hours before the journey, the experience will be canceled automatically, and you will receive a full refund.
9.2 Making Changes or Cancellations
To avoid any misunderstandings, all changes—such as rescheduling an Activity or modifying participant details—and cancellations must be made through the guideit Platform, unless otherwise agreed in advance.
Requests can be submitted using the appropriate form available via our Contact Us page. It is your responsibility to ensure that any cancellation or modification request is submitted in a timely manner, which depends on the specific conditions of the Activity—such as the applicable cancellation window and the Supplier's availability.
Please carefully review the Activity details and the guideit's Terms and Conditions to understand the applicable timelines and rules. What determines a cancellation as being "on time" is the rules. What determines a cancellation as being “on time” is the receipt of your request by guideit within the required timeframe.
If all conditions are met, guideit will issue a confirmation of the change or cancellation on behalf of the Supplier, which serves as your official proof and should be kept for your records.
9.3 Notifications of Changes or Cancellations
guideit may notify you of Activity changes or cancellations on behalf of the Supplier, particularly in cases of short notice. Notifications may be sent to the app inbox section, telephone number and email address you provided during booking.
9.4 Default Cancellation Terms
Unless otherwise specified in the Activity description, guideit’s Cancellation Policy, or on your voucher/ticket, the following standard cancellation policy will apply:
- a. ancellations made more than 48 hours before the scheduled start time of the Activity: You will receive a full refund of the Booking Price.
- b. Cancellations made 48 hours or less before the start time, or in case of a no-show: No refund will be issued.
9.5 Refund Method
If you cancel an Activity and are eligible for a refund, the amount will be returned to you using the same payment method you used when booking.
Alternatively, if you prefer, you may choose to receive your refund as a guideit credit, which can be applied to future bookings on the platform.
10. Reviews and Ratings
10.1 - guideit allows you to explore reviews, images, and other contributions shared by fellow users. These insights reflect each person’s individual experience and perspective at the time they engaged with the Activity, and may not accurately reflect the current offering.
Please consider the following when reading user content:
- a. Experiences are highly subjective and shaped by personal expectations.
- b. The details of an Activity may have changed since a review was posted.
- c. A larger number of reviews typically provides a more reliable impression than a single opinion.
10.2 - You can help shape the guideit community by submitting your own reviews and photos of Activities you've booked—collectively referred to as “User Content.” You are solely responsible for the content you share.
The following types of User Content are strictly prohibited on the guideit Platform:
- a.Content that is false, deceptive, or misleading
- b. Content that promotes or advertises products, services, or businesses
- c. Content created in exchange for compensation from a third party
- d. Content written by or on behalf of a Supplier
- e. Content that infringes intellectual property rights, privacy, or other legal rights
- f. Content that includes malicious links, code, or references that may interfere with third-party systems
10.3 - Before uploading any images or other User Content to the guideit APP, you are responsible for ensuring that you hold all necessary usage rights.
In particular:
- a.Content that is false, deceptive, or misleading
- b. Content that promotes or advertises products, services, or businesses
- c. Content created in exchange for compensation from a third party
- d. Content written by or on behalf of a Supplier
- e. Content that infringes intellectual property rights, privacy, or other legal rights
- f. Content that includes malicious links, code, or references that may interfere with third-party systems
10.4 Unless otherwise specified in the Activity description, guideit’s Cancellation Policy, or on your voucher/ticket, the following standard cancellation policy will apply:
- If your photos include recognizable individuals, you must have their explicit consent before sharing the image.
- If the image was taken by someone else, you must also obtain permission from the photographer before uploading.
By posting content, you confirm that you have secured the appropriate rights and consents required for its lawful use.
10.5 - You remain the sole owner of any User Content you create and upload to the guideit Platform. However, by submitting such content, you grant guideit a non-exclusive, worldwide, royalty-free, and fully paid license to use your content across any current or future media or format.
This license includes the rights to: Use, reproduce, modify, adapt, translate, and create derivative works, Display and perform your content publicly, Distribute and transmit your content.
(i) Sublicense these rights through one or more levels of partners or affiliates guideit may use your User Content:
(i) On the guideit Platform, (ii) Via our distribution partners, (iii) In promotional materials, both online and offline
This ensures we can share and promote authentic experiences from our community while respecting your ownership.
10.6 - We reserve the right to remove User Content at any time, at our sole discretion. For example, guideit may delete User Content if, in our view, it violates the requirements outlined in Sections 10.2 to 10.4. We are under no obligation to retain copies of any User Content or to provide copies upon request.
10.7 - guideit, along with its affiliates, sub-agents, and distribution partners, may display advertisements or other informational content next to or alongside your User Content—both on the guideit Platform and across other media channels.
You are not entitled to any compensation for the display of such advertisements. We reserve the right to modify the type, placement, and scope of these advertising measures at any time, and we are not required to notify you of any such changes.
11. Data Protection
All personal data you provide through the guideit Platform is handled by guideit as the data controller, in full compliance with applicable data protection laws and in line with the purposes outlined in our Privacy Policy.
Your personal data may be shared with Journey Providers (Suppliers) when necessary for: Fulfilling the Journey Service Agreement between you and the Supplier, meeting legal obligations, other purposes legally permitted under data protection law.
It is important to note that Suppliers act as independent data controllers and are solely responsible for how they process your personal data.
You can refer to our Privacy Policy, for more information about your data protection rights, including accessing, correcting, or deleting your personal data.
12. Indemnification
You agree to fully indemnify and hold guideit harmless from any and all damages, losses, costs, and expenses (including reasonable legal fees) incurred by us, our affiliates, agents, or partners as a result of:
12.1 - Any intentional or negligent misstatement, act, or failure to act on your part in connection with your use of the guideit Platform;
12.2 - Your intentional or negligent failure to comply with guideit Terms and Conditions;
12.3 - Any claims brought by third parties arising from or related to your access to or use of the guideit Platform that intentionally or negligently violates these Terms.
13. Assignment
You are not permitted to transfer or assign any of your rights or obligations under these guideit Terms and Conditions, except for claims related to damages.
14. Severability Clause
If any provision of these guideit Terms and Conditions is or becomes wholly or partially invalid or unenforceable, this shall not affect the validity of the remaining provisions.
In place of any missing or invalid provision, the applicable statutory law shall apply. If no suitable legal provision exists or applying it would result in an unreasonable outcome, the parties agree to enter into good faith negotiations to replace the invalid provision with one that reflects, as closely as possible, the original economic intent.
15. Supplier – Service Agreement
15.1 Conclusion of Contract with the Supplier
15.1.1 When you select and book an Activity through the guideit Platform, you are entering into a direct contractual agreement with the Supplier of that Activity. guideit acts solely as the commercial agent on behalf of the Supplier in facilitating this agreement.
15.1.2 Once you’ve confirmed the availability of an Activity, you can book it by selecting the “Book” button at the end of the page. You can book for more than one person, by editing the number of adventurers. To proceed, click on “Confirm and Pay”, where you’ll be prompted to provide the required details—most importantly, your preferred payment method, which must be completed to continue the booking process.
15.1.3 By clicking the “Pay” button at the end of the booking process, you submit a legally binding offer to enter into a Service Agreement with the Supplier responsible for delivering the selected Activity. This offer remains binding for a period of two business days. Once your offer is received, guideit—on behalf of the Supplier—will send you an automated order confirmation. Please note that this confirmation does not yet represent acceptance of your offer.
15.1.4 Suppliers may include their own terms and conditions within their Activity listings on the guideit Platform (referred to as “Supplier T&Cs”). We strongly encourage you to review these terms carefully, as they may contain important details—such as cancellation policies, rescheduling options, or other specific conditions. Please note that the Supplier T&Cs do not affect your relationship with guideit or our legal responsibilities. In cases where a conflict arises between the Supplier T&Cs and Section 9 of these guideit Terms and Conditions, the provision that is more favorable to you will take precedence in your agreement with the Supplier.
15.1.5 Your offer is formally accepted—in the name and on behalf of the Supplier—once you receive a booking confirmation issued on behalf of the Supplier. This may also be accompanied by access to a voucher or ticket (either as a mobile version or downloadable PDF), along with a payment confirmation. guideit reserves the right to accept or decline any contract offer at its sole discretion.
15.1.6 There is no separate written contract issued between you and the Supplier. The terms of your agreement are defined by the details of the booked Journey (i.e. the activity you selected), the applicable provisions outlined in Section 15 of these guideit Terms and Conditions, and—where relevant—the Supplier’s own terms and conditions.
15.1.7 Upon receiving your order confirmation, you are required to promptly review it to verify that all details—such as dates, participant information, and selected options—have been entered correctly.
15.2 - Prices
15.2.1 In most cases, the Posted Prices displayed on the guideit app include all applicable taxes and fees. However, there may be instances where additional local taxes or charges are applied at the destination.
If such additional costs apply, they will be clearly disclosed in the Activity description prior to booking.
15.2.2 The Posted Prices set by Suppliers may be tied to specific terms, such as conditions for cancellations or refund eligibility. It is your responsibility to independently review whether the Supplier has outlined any deviating terms before completing your booking.
15.3 Provision of the Activity
15.3.1 ou are required to arrive punctually at the meeting point specified by the Supplier. Please ensure you have reviewed and understood the applicable Supplier T&Cs.
If you are traveling internationally to participate in the Activity, it is solely your responsibility to ensure that you possess the necessary travel documentation (such as visas) and comply with any health, entry, or legal requirements relevant to your destination
15.3.2 The Booking Price does not include any form of insurance. It is your responsibility to ensure you have adequate coverage. We strongly recommend purchasing travel insurance, particularly for Activities that involve outdoor environments or are considered high-risk.
Please note that guideit does not operate the tours, employ the guides, or establish safety standards for the Activities listed on our platform.
15.3.3 Suppliers operate as independent contractors and are not agents or employees of guideit. We are not responsible for any actions, errors, omissions, representations, warranties, breaches, negligence, or misconduct by any Supplier. This includes—but is not limited to—any personal injury, death, property damage, or other losses or expenses that may arise in connection with a booking or participation in an Activity.
15.3.4 All time-related calculations, including deadlines and scheduling, shall be based on the local time zone of the Supplier
15.4 Further Rights of the Supplier
15.4.1 The Supplier reserves the right to cancel the Activity on the scheduled date without prior notice if unforeseen circumstances beyond their control—such as adverse weather, governmental actions, strikes, or other external events (including force majeure)—make it impossible, unsafe, or unreasonably difficult to carry out the Activity.
In such cases, any Booking Price already paid for the canceled Activity will be refunded. If you believe you are entitled to additional compensation, such claims must be directed to the Supplier, as outlined in Section 15.3.3.
15.4.2 The Supplier has the right to exclude you from participating in an Activity if:
(i) you fail to meet the participation requirements outlined on the guideit Platform,
(ii) your participation would pose a risk to yourself or others, or
(iii) you disrupt the proper execution of the Activity in any manner.
In such situations, you will not be entitled to a refund of the Booking Price.
15.4.3 The Supplier may implement minor changes to the Activity’s itinerary at any time if short-notice circumstances make such adjustments necessary. These non-material modifications may include changes to the starting or meeting location, provided the new location is reachable from the original one within 15 minutes on foot or by public transportation.
Such changes may be made up to 24 hours before the Activity begins and will be communicated to you via email or shown directly within the guideit app.
16. Final Provisions
16.1 To fulfill our contractual obligations and enforce any rights granted to us under these Terms and Conditions, guideit may engage other affiliated entities or third-party service providers to act on our behalf as authorized agents.
16.2 We reserve the right to modify or update these guideit Terms and Conditions in the future, to reflect any changes in legislation, market developments, or to address regulatory or contractual gaps. If changes are made, we will notify you in advance and through appropriate channels.
If you do not agree with the updated terms, you or guideit may choose to terminate your account or access to the platform immediately.
16.4 The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply to these guideit Terms and Conditions or to any transactions carried out under them.
16.5 The contract between you and guideit is deemed to be formed and executed in Baabda, Lebanon.
16.6 For the purposes of these guideit Terms and Conditions:
(i) The term “including” shall always be interpreted as “including but not limited to”;
(ii) General terms shall not be interpreted narrowly simply because they follow specific examples or categories; (iii) Words in the singular include the plural, and vice versa.
Section headings and captions are provided for ease of reference only and do not affect the interpretation of these Terms and Conditions.

A1. Liability
A1.1 Except as otherwise provided in Section A1.2, guideit's maximum liability—arising from or in connection with the performance of our contractual obligations—shall be limited to the typical and foreseeable loss or damage resulting from a negligent breach of a fundamental contractual duty.
A fundamental contractual duty refers to an obligation essential to fulfilling the core purpose of these Terms and Conditions, the breach of which would compromise the very intention of the agreement and one upon which you, as a user, can reasonably rely.
Loss or damage is considered typically foreseeable if such outcome was reasonably predictable at the time you agreed to these Terms.
guideit, along with any of its agents or representatives, disclaims liability for any damages resulting from the negligent breach of non-essential contractual obligations.
A1.2 Nothing in these guideit Terms and Conditions limits or excludes our liability—or that of our agents or representatives—for gross negligence, willful misconduct, death, personal injury, or fraud.
Additionally, any broader statutory rights granted to you as a consumer under applicable law shall remain fully in effect and unaffected by these terms.
A1.3 The above limitations on liability do not apply in cases where guideit has fraudulently concealed a defect affecting the standard or performance of the platform, or where we have provided a guarantee for a specific feature or functionality.
Similarly, these limitations do not affect any claims you may have under applicable product liability laws.
A1.4 guideit shall not be held liable for any damages or losses resulting from force majeure events. These include, but are not limited to: failures in electronic or mechanical systems or communication lines, actions by third parties (such as denial-of-service attacks or misuse of the guideit app and Website), interruptions in telephone or internet connectivity, malware or computer viruses, unauthorized access, data theft, or operator errors, fires, floods, extreme weather conditions, actions by governmental, regulatory, or supranational authorities, war, civil unrest, pandemic, or labor disputes.
These circumstances are considered beyond our reasonable control and release us from liability during their duration.
A1.5 You retain the right to demonstrate to the Supplier that no damage was incurred, or that the actual damage resulting from your cancellation is substantially lower than the cancellation fee being charged by the Supplier.
A2. Indemnification
A2.1 For the purposes of Section 12.1, damages also include any compensation or liability that we may incur toward our agents or auxiliary personnel (as defined under Lebanese law) as a result of any of the events outlined in Section 12.
A3.2 The obligations outlined in Section A3.1 will apply only if you are found responsible for the occurrence of the events described in Section 12 or for breaching these guideit Terms and Conditions. This means that the event or violation must have resulted directly from your intentional actions or negligence.
A4. Governing Law
Unless otherwise required by mandatory local consumer protection laws in your country of residence, these guideit General Terms and Conditions and any services provided by guideit will be governed and interpreted in accordance with the laws of Lebanon.
A5. Jurisdiction for Non-Lebanon Residents
If your primary residence is outside of Lebanon, then—subject to any overriding mandatory consumer protection laws in your country of residence—any disputes arising from or related to these Terms or your use of the guideit platform shall fall under the exclusive jurisdiction of the competent courts in Baabda, Lebanon.
A6. Right of Withdrawal
If you are classified as a consumer—meaning a natural person acting for purposes unrelated to trade, business, craft, or profession—and your habitual residence is within Lebanon you may generally have a statutory right of withdrawal as described below.
Please note, however, that certain types of contracts are legally exempt from the right of withdrawal, which means this right may not apply to your specific agreement.
A6.1 Exclusion of the Right of Withdrawal
According to applicable consumer protection laws, the right of withdrawal does not apply to distance contracts that involve the provision of leisure-related services if those services are scheduled for a specific date or time period.
This includes—but is not limited to—pre-booked or time-sensitive services such as:
- Tours
- (Multiple) Day Trips
- Admission or Entrance Tickets
- Guided Excursions
- Water-Based Activities
- Outdoor or Adventure Experiences
- Combined or Package Offers
These activities are generally non-refundable once the booking is confirmed, as they are considered date-specific services that require guaranteed attendance and capacity planning by the Supplier.
A6.2 Instructions concerning the exercise of the right of withdrawal
A6.3 Right of withdrawal
You are entitled to cancel this contract within 14 days without needing to provide a reason.
The withdrawal period ends 14 days after the day you, or someone you’ve authorized (who is not the delivery carrier), takes physical possession of the last item in your order.
To exercise your right of withdrawal, you must notify us —

with a clear statement (such as a letter by email) indicating your decision to withdraw from the contract.
To meet the 14-day deadline, simply send your withdrawal notice before the period ends.
A6.4 Effects of Withdrawal
If you decide to withdraw from this contract, we will refund all payments received from you — including standard delivery costs (excluding any additional charges incurred by choosing a delivery method other than our least expensive standard option) — without undue delay and no later than 14 days from the date we are notified of your decision to withdraw.
Your refund will be processed using the same payment method used for the original transaction, unless you have expressly agreed to a different method. You will not be charged any fees for the reimbursement.
You must return the goods to us — or hand them over — without unnecessary delay, and no later than 14 days from the date you notify us of your withdrawal. The return deadline is considered met if the items are dispatched before the 14-day period expires. The cost of returning the goods will be covered by us.
You will only be held responsible for any reduction in the value of the goods resulting from handling them in a way that exceeds what is necessary to examine their nature, characteristics, and functionality.
Appendix B
Clauses Applicable Only to Residents of the U.S.
B1. Warranty Disclaimers
To the fullest extent permitted by applicable law, and unless expressly stated otherwise in this agreement, we do not make — and specifically disclaim — any representations or warranties, whether express, implied, statutory, or otherwise, relating to the services and activities described herein.
This includes, but is not limited to:
- Implied warranties of merchantability,
- Fitness for a particular purpose, and
- Warranties arising from prior course of dealing, performance, or trade usage.
The guideit Platform is provided to you strictly "as is" — without any guarantees of any kind.
We do not guarantee that:
- The platform will fully meet your expectations,
- Its operation will be uninterrupted, secure, error-free, or free from viruses, or
- The content on the platform will be accurate, complete, or protected from unauthorized changes.
Furthermore, we are not responsible for the accuracy or completeness of any data supplied by third-party Suppliers.
B2. Activity-Related Liabilities
B2.1 Injury Incidents
You acknowledge and agree—both for yourself and for anyone you booked an Activity for (each referred to as a “Co-Journeyer”)—that all Activities are offered and operated by independent Suppliers, not by guideit
These Suppliers are third-party businesses and are not controlled by US.
If you or a Co-Traveller experiences injury, death, or any type of loss in connection with an Activity (referred to here as an “Injury Incident”), you agree to pursue any claims or compensation directly with the Supplier responsible for providing that Activity.
You further agree that guideit, along with its affiliates, subsidiaries, distribution partners, and their respective officers, directors, employees, and agents, shall not be held liable for any Injury Incident.
B2.2 Release of Liability
By using guideit and booking any Activities through the platform, you, on behalf of yourself and any Co-Travellers, irrevocably release and discharge guideit, its affiliates, subsidiaries, partners, and their respective officers, directors, employees, and agents (collectively, the “guideit Parties”) from any and all claims, demands, causes of action, obligations, losses, damages, liabilities, and expenses (including, without limitation, attorneys’ fees), whether known or unknown, suspected or unsuspected, that arise out of or relate in any way to any injury, loss, or incident occurring during or in connection with any Activity.
B2.3 Agreement Not to Pursue Claims
You agree and commit that neither you nor any Co-Traveller will initiate, pursue, or encourage any legal action, lawsuit, arbitration, or other proceeding—whether in law or equity—against guideit or any of its affiliates, agents, employees, or partners (“guideit Parties”) arising from or related to any Injury Incident.
Should such an action be filed in violation of this covenant, these Terms may be used as a full and binding defense to bar the claim in its entirety.
B2.4 Third-Party Rights
The guideit Parties are explicitly identified as third-party beneficiaries of this Section B2. Each of these Parties has the independent right to enforce the terms of this section against you, to the extent that it protects their respective interests as outlined here.
B3. Limitation of Liability
B3.1- Waivers:
To the maximum extent permitted by applicable law, guideit shall not be held liable for any indirect, incidental, special, consequential, exemplary, or punitive damages. This includes, but is not limited to, loss of profits, loss of revenue, loss of data, or costs incurred in obtaining substitute services or goods. These limitations apply regardless of the legal theory involved—whether in contract, tort (including negligence, strict liability, or product liability), or otherwise—and even if we were aware, or should have been aware, of the potential for such damages. This limitation applies despite the failure of any stated remedy to fulfil its intended purpose.
B3.2 Liability Cap
To the fullest extent permitted by applicable law, if guideit is found liable for any loss or damage related to these Terms—whether arising from your use of guideit’s services, your participation (or decision not to participate) in an Activity, or any Injury Incident—our total cumulative liability will not exceed the greater of:
(a) the amount you paid to guideit in connection with the specific Activity that gave rise to the claim (if applicable), or
(b) two hundred U.S. dollars (USD $200.00), in total.
B3.3 Risk Allocation
You acknowledge and agree that the limitations of liability outlined in this Section B3 represent a fair and reasonable distribution of risk between the parties. These provisions are a fundamental basis of the agreement between you and guideit, and guideit would not be able to offer its services on these terms without such limitations. Under no circumstances shall guideit be held liable for the actions or omissions of any Supplier.
B4. Arbitration
Please review this section carefully as it may impact your legal rights. By agreeing to these Terms, you acknowledge that most disputes will be resolved through arbitration rather than litigation in court. Arbitration is a less formal process than court proceedings—it involves a neutral arbitrator rather than a judge or jury, and typically includes limited discovery. The decisions reached through arbitration are final and binding, with only very limited options for judicial review. This arbitration provision shall remain in effect even after the termination of your guideit account.
B4.1 Binding Arbitration
This arbitration clause is intended to be interpreted broadly and covers any and all disputes or claims arising from or relating to the guideit platform, our services, these Terms and Conditions, or your relationship with us—including our parent, subsidiary, or affiliated companies. This includes claims based on contract, tort, statute, misrepresentation, fraud, or any other legal theory, as well as any disagreements about the interpretation, enforceability, or scope of this arbitration provision and whether a particular dispute is subject to arbitration (collectively referred to as “Claims”). All such Claims will be resolved exclusively through binding arbitration, unless specifically excluded as outlined in Section B4.4.
B4.2 Opt-Out Option
Despite the arbitration agreement set forth in Section B4.1, you have the right to opt out of binding arbitration. To do so, you must submit a written opt-out notice by mail following the process described here. Your opt-out notice must be postmarked no later than 30 calendar days from the earliest of the following dates: (i) the date you first used the guideit platform, (ii) the date you first accessed any of our services, or (iii) the date you completed your first transaction with us (this marks your “Opt-Out Deadline”).

Please note: Opt-out notices postmarked after the Opt-Out Deadline (plus a grace period of three (3) additional calendar days for mailing) will not be accepted. If your opt-out notice is late, you will be required to resolve disputes through binding arbitration or in small claims court as applicable.
B4.3 Claims Not Subject to Arbitration
The following types of claims are excluded from mandatory arbitration and may be brought before a court of competent jurisdiction (as outlined in Section B5):(i) Claims involving alleged or actual infringement, misappropriation, or violation of intellectual property rights, including copyrights, trademarks, trade secrets, or patents; (ii) Claims seeking urgent injunctive relief due to emergency circumstances—such as imminent criminal activity, hacking, or cyber-attacks; (iii) Requests for public injunctive relief, in cases where such remedies are available and cannot be waived under applicable law. Additionally, either party may choose to bring a qualifying claim in small claims court, subject to the jurisdictional limits and conditions specified in Section B5.
B4.4 Arbitration Procedure
Before initiating any legal proceeding or arbitration, you must first submit a written claim using the contact form available at [Contact us ⎸guideit]. This allows us the opportunity to resolve the issue directly. If we are unable to resolve your concern within 60 days of receiving your written submission, you may then proceed with arbitration.
All arbitration proceedings will:
- Be conducted by a single, neutral arbitrator;
- Be carried out in English/Arabic;
- Follow the Arbitration Rules of the International Chamber of Commerce (“ICC Rules”), supplemented by the IBA Rules on the Taking of Evidence in International Commercial Arbitration (1999). In the case of conflict between the two, the IBA Rules will take precedence—but only concerning evidence.
Note: Neither party may apply for discovery under 28 U.S.C. § 1782.
The arbitrator will only be allowed to grant the types of damages specifically permitted under these Terms & Conditions and in accordance with any stated disclaimers or limits on liability.
If a judgment is awarded, it may include:
- Arbitration costs;
- Reasonable legal fees;
- Reasonable expenses for expert witnesses and other case-related costs.
All arbitration proceedings are strictly confidential. Neither you nor guideit may disclose the existence, content, or outcome of the arbitration, except where legally required or needed to enforce the award.
Arbitration decisions may be enforced in any court with appropriate jurisdiction.
For disputes involving less than $25,000, arbitration will be handled entirely through written submissions, unless:
If a judgment is awarded, it may include:
- You request a phone or in-person hearing; or
- The arbitrator decides that a hearing is necessary for a fair resolution.
If a hearing is required, telephone hearings are preferred unless fairness requires an in-person session. In-person hearings, if necessary, will take place in New York, New York, unless the arbitrator orders otherwise.
B4.5 Class Action Waiver
You and guideit agree that any legal proceeding—whether in arbitration or court—must be conducted solely on an individual basis, and not as part of any class, collective, consolidated, or representative action.
This means:
- You cannot act as a class representative, be part of a class, or join a collective legal action against guideit.
- Only your individual claim may be resolved in arbitration or court—not claims involving others.
If a court or arbitrator rules that this class action waiver is unenforceable in a dispute between you and guideit, then the entire Section B4 (Arbitration Clause) will not apply to you.
Additionally, if you opt out of arbitration in accordance with Section B4.2, this class action waiver will also not apply to you.
Should any specific provision of this arbitration agreement be deemed unenforceable, that particular clause will be severed, and the remainder of the arbitration agreement will continue to be valid and enforceable.
B5. Governing Law
Except as provided in Section B4.3 (regarding the application of U.S. federal arbitration law), these Terms and Conditions are governed by the laws of the State of New York, without regard to any conflict of laws principles that might otherwise apply.
B6. Venue
Any legal action, suit, or proceeding arising out of or related to these Terms and Conditions or the services we provide — including (i) actions brought by a User who has opted out of binding arbitration under Section B4.2, and (ii) proceedings brought in small claims court — shall be brought exclusively in the state or federal courts located in Kings County, New York. Each party irrevocably submits to the personal jurisdiction of these courts, agrees that this venue is appropriate and convenient, and waives any objection to transferring the matter to another jurisdiction, including objections based on forum non conveniens.
B7. Jury Trial Waiver
In the event that any claim proceeds in a court of law rather than through arbitration, both you and guideit knowingly and voluntarily waive any right to a trial by jury in any legal proceeding related to these Terms or the services provided. This waiver applies to any claim, action, or proceeding, whether sounding in contract, tort, or otherwise.
